Cape Town – Deputy Home Affairs MinisterMalusi Gigaba is looking at ways to ban pornography on the internet and cellphones.

Gigaba met the Justice Alliance of South Africa (Jasa) this week to discuss its draft legislation on the matter.

He said this was part of his ongoing work in “providing stewardship” to the Films and Publication Board (FPB).

Jasa director John Smyth presented the draft bill and the legal opinion on the constitutional issues related to the bill.

Jasa’s draft internet and cellphone pornography bill proposed that pornography be filtered out at the tier one service providers to avoid it entering the country.

The bill was aimed at the total ban of pornography on the internet and mobile phones.

Gigaba said it was noted that unlike in the physical world where a reasonable effort could be made for pornography to be kept away from children, in the online world, pornographic sites were often “parked deliberately next door” to educational sites, often with names almost identical.

Electronic channels

Current legislation, particularly the Film and Publication Act, provided for a ban on child pornography, whereas the proposed bill provided for a total ban on pornography on these electronic channels using the wider definition of pornography already available in the Sexual Offences Act.

“Cars are already provided with brakes and seatbelts; it is not an extra that consumers have to pay for.

“There is no reason why the internet should be provided without the necessary restrictive mechanisms built into it,” Gigaba said.

He had asked the Law Reform Commission (LRC) to provide advice on the possibility of legislating against pornography on the internet, television and mobile phones.

The LRC was currently researching the matter, Gigaba said.

  1. I hope not. They have been really good in the past. I remember when South Africa got it’s new constitution, Hustler Magazine spent millions and millions of rands every year in court defending our rights to choose for ourselves. Out of basic principle I bought a subscription. It was the first time you could enjoy a magazine that showed nice looking naked women and people fucking in our country. I remember every month when it was delivered to our house, the wrapping would have been torn off, and I would hear comments from my dad, my sisters and even sometimes my mother. Comments ranging from: “Utter filth, oh my god, how can you read this?, I can’t believe what they get away with!, holy shit!!!!!” etc etc etc. My point is that everyone chose to read it or look through it. It was their choice. I loved it. And I enjoyed reading about their court battles. Back then they were fighting the religious wankers who couldn’t stand it that people were allowed to make their own choices of what to read and what not to. Nothing changed. Not even their arguments. The big lie that porn is bad for you, it leads to rape and child molestation, has never been proved. Lies for jesus. What a bunch of cunts!!!!!

  3. Yes, I still remember how the church and the National Party went berserk at Scope magazine’s girls in bikinis. Every magazine they banned was set aside on apeal by the courts. So what did they do? Old asshole Connie Mulder appointed a judge Lammie Snyman, who Mulder had in his pocket, as the sole arbitrater (read banner) of all published material they saw fit to ban.

    They went so out of control that they started banning books; Andre P Brink, and even Etienne Leroux’s “Magersfontein o Magersfontein. You don’t stop the fundies once you give them power.

    Here is an excerpt from “Inherent the Wind”, the movie about the Scopes monkey trial in Tennessee when the teaching of evolution was banned in the schools:

  5. Ha-ha. No. I have met many who tried to tell me that their trade (philosophy), is a “god send” to all us mortals. They tried to tell me that we would still be banging rocks together to make fire, if it wasn’t for their “trade”.

    But in my limited own experience, it seems to me they have been trying to take credit from lots of other trades.

    Most philosophers are like priests. They peddle crap, wrapped in multiple layers of bullshit.

    You can never get them in a corner. They keep changing the subject, and they keep rambling on and on about some shit you can’t understand, and then they say: “well, if you don’t even get this, you will never understand what we are trying to tell you.”

    You can’t prove a fucking thing against a philosopher.

  6. At one stage, many, many years ago, philisophers also tried their hand at science. But the scientists quickly formulated the “Laws of Philosophy”, (akin to Newton’s laws of motion).

    “The First Law of Philosophy: For every philosopher, there exists an equal and opposite philosopher. The Second Law of Philosophy: They’re both wrong.”
